Michigan seeking to reclassify industrial properties

Several of our clients have received notice that the Michigan Department of Treasury is seeking to reclassify their property from industrial to commercial. Industrial personal property gets a tax break as compared to commercial property. So, if you can make a clear showing to the Department that there is manufacturing or processing taking place on the property, the Department will withdraw the petition. You will need to prove this in a formal “answer” to the petition.

Many clients are also concerned about these reclassification appeals because they think it will affect the zoning of their property. Zoning classification is entirely different from property tax classification and that should not be a concern.
