Divorce in troubled economic times

Here’s the scenario: you were thinking about a divorce and ready to act. Then the stock market tumbled, home values plummeted and who knows the value of your 401(k) and other holdings. You don’t even want to look. Yet the situation on the home front is the same as it was when you first thought about divorcing. In other words, intolerable. What should you do? Divorce now or wait it out?

The answer depends upon a number of factors. To make the right decision for your particular situation, begin by asking yourself a few basic questions:
  • Are you in a loveless, stagnant or high-conflict marriage but staying together “for the kids’ sake”?

  • Have you done anything that could make matters worse by waiting?

  • Are you assuming that you’ll pay or receive as much or as little as your friends and relatives did in their divorces?

  • Do you have reason to believe the situation will improve in the near future?

  • Are you waiting based upon what your spouse told you?

  • Have you been immobilized by divorce “horror stories”?
For most people, a divorce is an emotionally-charged event. But the decision whether to file for divorce needs to be a rational one because there’s a lot riding on it.
